ENROLLMENT PRIORITIES

Nothing in the enrollment priorities shall be construed as an obligation of the District to enter into or to renew any interdistrict transfer agreement.

Subject to Board Policy No. 5116.1, the following enrollment priorities shall be administered on a space-available basis, subject to the reasonable discretion of District administration to address issues that may impact the operation of the District, its schools and/or programs.

The following portion of this regulation was reviewed on September 20, 2018.

A. For neighborhood schools, the enrollment priorities shall be the following:

 1. First priority to students in grades K-8 to attend their assigned neighborhood school.     
    a. Students who are fifth-graders in 2019-20, currently attending a school other than their assigned neighborhood school, will complete their final year at their current school for the 2019-20 school year only.       
     i. Students who are siblings of these fifth-graders may attend their older siblings' school for 2019-20 only. 

   b. Students who are new to the district and are fifth graders in 2019-20 whose neighborhood school is the new Jose Antonio Vargas Elementary will attend Theuerkauf Elementary School.

2. Second priority to students who are children of salaried District employees (at least 0.5 FTE)

3. Third priority to students who apply to under-enrolled schools. Under-enrolled schools are defined as having at least 25 percent excess capacity. The list of schools will be updated annually.

4. Other transfer requests may be approved under special circumstances such a Title IX civil rights, special education placement for special day classes at designated school sites and for active US Military to Monta Loma only. The following portion of this regulation was reviewed on November 20, 2014 and remains in effect.

B. For Choice schools (Gabriela Mistral Elementary and Stevenson Elementary) the enrollment priorities shall be the following:

1. Priority for students currently enrolled in a particular program in the District:
   a. First priority to students who reside in the District and were enrolled in the same program during the prior school year.
   b. Second priority to students who are children of salaried District employees (at least 0.5 FTE), attend pursuant to an interdistrict transfer agreement, and were enrolled in the same program during the prior school year.
   c. Third priority for students who attend pursuant to an interdistrict transfer agreement and were enrolled in the same program during the prior school year.

2. Fourth priority for students who live within the District and have siblings that will continue in the program under Paragraph 1a above.

3. Priority for children of other District employees:
   a. Fifth priority for students who are children of salaried District employees (at least 0.5 FTE), live within the District, and are new to the program, but only with respect to employees who are assigned to the site.
   b. Sixth priority for students who are children of salaried District employees (at least 0.5 FTE), attend pursuant to an interdistrict transfer agreement, and are new to the school, but only with respect to employees who are assigned to the site.
   c. Seventh priority for students who are children of salaried District employees (at least 0.5 FTE) who are not assigned to the site, live within the District, and are new to the program.
   d. Eighth priority for students who are children of salaried District employees (at least 0.5 FTE) who are not assigned to the site, attend pursuant to an interdistrict transfer agreement, and are new to the program.

4. Ninth priority for all other students who live within the District and are new to the program. 5. Tenth priority to all other students who attend pursuant to an interdistrict transfer agreement and are new to the program.
